INTERNATIONAL INITIATIVE BRIEFINGS:

We document the 'Declaration on Peace and Democracy' which has been signed and published by 319 institutions and associations including political parties, labour unions and many of NGOs in Kurdish cities. This is a translation from the Turkish original:

"DECLARATION on PEACE and DEMOCRACY

Demands for a comprehensive restructuring of Turkey at political, societal and administrative levels, have been voiced with increasing intensity in recent years by individuals and pressure groups from all walks of life. These demands can only be met by a thorough and properly constructed process of democratisation. A widening consensus among the various layers of society has generated conditions more conducive to conciliation than ever before and this atmosphere has been further encouraged by the fact that the cessation of hostilities and subsequent developments have nurtured hopes that violence as a policy may have been abandoned, never to be resorted to again. This has resulted in the emergence of a historic opportunity for the establishment of a permanent peace. Developments at European Union level and Turkey's vow to fully adhere to the Copenhagen Criteria have also played their part in encouraging increasing support for demands for democratisation. In this respect it is our opinion that the granting of full EU membership Turkey would be an important step.

The pivotal requirement that our country must fulfil in order to take its place among the modern and progressive states of the world is to internalise and implement universal legal norms based on human rights law. We, the undersigned non-governmental organisations, political parties, professional associations and chambers of commerce, have come together to emphasise the importance of raising awareness of the following issues among those concerned and in authority, in order that the necessary steps might be taken.

1. The Drafting of a Constitution in the Spirit of Democracy and Liberty

The Constitution is the most fundamental contract referred to by any set of legal provisions since it forms the framework of the political, administrative, social, economic and legal system. The present Constitution of the Republic of Turkey, however, was drafted under exceptional conditions and without taking into account the real circumstances of the state. Today the legitimacy of the 1982 Constitution is highly controversial: it sanctions gross curtailment of fundamental rights and freedoms and is incompatible with international human rights covenants and the universal norms of law. A clear recognition of the culturally diverse fabric of Turkey is required when, with the participation of civil society, the urgent task of drafting a new Constitution in the spirit of freedom and democracy is undertaken.

2. Priorities in Economic Development Programs

The armed conflict that raged for many years in our region has left its economy devastated. Agriculture and stockbreeding, once the primary source of income, have collapsed. The rural population has been uprooted and hunger and misery have reached a level incomparably higher than that experienced in other parts of Turkey. Unemployment has literally taken on the character of a threat and the economic crisis of 2001 dealt a lethal blow to social peace. Small and medium scale businesses in both the service and industrial sectors have been forced to close for lack of investment, and production has come to a standstill. Mass migration has left millions of hectares of fertile land barren for years on end. Our region needs to be given priority in special programs for economic development, and new areas of economic activity have to be created in order to secure employment. Land left uncultivated must be opened up to production and to that end the necessary social conditions for resettlement schemes, including education and health requirements, have to be satisfied.

3. Guaranteeing the Right to Life

Turkey, the only country among the 43 member states of the Council of Europe to retain the death penalty, must abolish capital punishment unconditionally by ratifying Additional Protocols Nos. 6 and 13 to the European Human Rights Convention. The killing of thousands of political opponents has to be exposed and explained. Extra-judicial killings, which still continue, if on a diminished scale, and torture and inhumane treatment - on the increase once more over recent months - must be halted.

4. Putting an End to the State of Emergency

The legal and administrative practise of the State of Emergency must be abandoned not only on the grounds that it contravenes human rights and modern law, but also for the tragic and devastating consequences it has had for those subjected to its implementation over a long period of time. The armed, paramilitary village guard militias have to be disbanded; they are inimical to the maintenance of peace and the promotion of social production. New opportunities for loans for the purpose of farming and stockbreeding have to be created.

5. A General Amnesty for Social Peace

For the sake of social reconciliation and for the establishment of a permanent peace, a non-discriminatory General Amnesty with particular emphasis on political prisoners is needed, rather than a re-tabled Repentance Act that requires an individual to incriminate others in order to be exempted from penalty. This is vital in order to overcome the risk of a renewed outbreak of violence, and to arrive at a truly democratic and peaceful settlement based on dialogue.

CONCLUSION

We believe that the fundamental rights and freedoms guaranteed to all citizens living in modern democracies should be granted to every individual and to all sections of Turkish society. Differences, which should be welcomed as part of society's wealth, should be accepted and upheld on the basis of equality in an atmosphere of peace. Every individual should have the right to participate in social life in his/her own way and to enjoy personal and collective rights. The right to freely express any opinion not containing a call to violence should be constitutionally safeguarded.

We, the undersigned representatives of NGOs, political parties, professional associations and chambers of commerce, hold it as an obligation, arising from the responsibility we feel towards Turkey and its society, to submit this Declaration to those who are concerned and competent, and to present it to the public.
